I. Welcome to Flowers By Nora. We are happy to have you. We pride ourselves on quality products and service. We would like to make you aware of the Terms of Service (“Agreement”). That correspond to the use of our website.

1. When your order from Flowers By Nora you enter into a legally binding contract. The agreement applies to and products and services we provide. Any information collected from you on our website is subject to a Privacy Policy. The Privacy Policy is stated within this agreement.
2. This Agreement is subject to Nevada Laws. Any cause of action you may have with Flowers By Nora must be commenced within two years after the claim arises. All claims are subject to mandatory arbitration in the jurisdiction of Nevada the venue being Superior Court. To access our website, you must be 16 years old and agree to the terms of the agreement.
3. Flowers By Nora website can not be copied in any way.
4. Flowers By Nora, may contain links to other world wide web internet sales. These third party sales may have privacy policies that differ from ours.

Calling and Messaging

Upon placing an order, Flowers By Nora has the right to call or text the customer to update them on the status of the order.

II. Using an Account at Flowers By Nora

1. You must be 16 years old.
2. You must agree to the terms of this agreement.
3. You can’t register for the use of a third party.
4. For account security you are provided with a password. If you disclose your user ID or password to another person or entity and allow them to access your account, you are responsible for any transactions related to your account.

III. Purchasing products

You must be 16 years old to purchase products on our website. When purchasing products, you agree to our terms and conditions.

VI. Delivery

1. In addition to our delivery network. We also use UPS, FedEx and USPS to deliver our flowers and products
2. We do not deliver flowers or other products for orders less than $29.99
3. 2PM local time is the cut off for same day deliveries
4. Orders after 2PM will be delivered the following business day.
5. Delivery hours are typically 9am to 7pm local time.
6. Orders placed on Sunday will be scheduled for delivery the following Monday.
7. Delays
   - We will make every effort to contact you.
8. Holidays we can not guarantee delivery on busy floral holidays ie Thanksgiving, Christmas, and Valentine’s Day. Please place these orders four days in advance to assure delivery.
9. Undeliverable Locations
   - These are not limited to cemeteries, cruise ships, airport terminals, post office boxes, remote locations and rural locations.
10. Non-Delivery / Late Delivery
    - Some conditions are outside our control road closures, traffic conditions, lack of access to the delivery address and weather conditions.
11. Incorrect or insufficient address provided.
12. These orders will be rescheduled at the next available delivery time or date.

V. Service Fees

- Will apply on delivery orders. They are stated at checkout.
- Some rural locations require and additional charge the customer will be notified.
- Any orders refused by the addressee will not be refunded.

VI. Substitution Policies

1. If a floral container or vase is not available a similar container will be substituted.
2. Flower arrangements and assorted flowers, if some flowers are not available, we will substitute other kinds of flowers at equal or greater value.
3. Specialty gifts may be substituted with another specialty gift of equal or greater value within the same category.

VII. Cancellations

Your order can be cancelled within 24 hours of order placement. Same day or next day delivery may not be cancelled.

VIII. Copyright and Trademarks

Flowers By Nora website is protected by US copyright laws. The website is only for your personal use.

IX. Indemnification

All customers agree to indemnify and hold harmless Flowers By Nora and all of its officer directors, owner, agents, employees, information providers, affiliates, licensors and licenses from and against any and all liability and costs incurred by the Indemnified Parties in connection with any claim. You are required to cooperate should any defense of any claim occur.

Mobile Terms of Service

The Flowers by Nora mobile message service (the "Service") is operated by Flowers by Nora (“Flowers by Nora”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Flowers by Nora’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Flowers by Nora through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list.

Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Flowers by Nora. Your participation in this program is completely voluntary. We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18667477809 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message.

No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Flowers by Nora mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
